Nursing Home Abuse Jury Verdict of More Than $5.5 Million in Colorado

A jury in Colorado awarded more than $5,500,000, $5 million of which was punitive in nature, to the family of a woman who was the victim of abuse which ultimately resulted in her death. The woman was 77-years-old on admission. She had multiple serious infections, bed sores (also called pressure sores, pressure ulcers, or decubitus ulcers), dehydration and malnutrition. An aggravating factor may have been the presence of several unexplained bruises she developed. One ongoing problem was the fact that her family found her repeatedly lying in her own urine and feces, sometimes for prolonged time periods. Poor staffing levels and a lack of continuity of care were concerns that one juror expressed in post-verdict interviews.
